These Terms of Service (‘Terms’) govern your access to and use of megapigs. Please therefore ensure you read these Terms carefully before

using the site. In using the site and/or creating an account, you agree to accept and be bound by these Terms.

How the website works

• You must be registered on megapigs in order to buy or sell through the site. Registration is free for both Buyers and Sellers
• Individual services are set at a fixed price, starting at $5
• Members outside of the US can pay for services in their local currency. All currency conversion rates are subject to the terms of the payment processor (e.g. PayPal/Payoneer/other payment partners)
• You may not offer or accept payment for services on megapigs using any method other than by placing an order through megapigs
• Buyers are granted all rights in the work delivered (e.g. copyright in designs), unless otherwise specified by the Seller within their service description or as agreed with the Buyer.

Sellers

Commission on Orders

• For each $5 service successfully completed, the Seller’s account will be credited with $4
• For each $10 service successfully completed, the Seller’s account will be credited with $8
• For each $25 service successfully completed, the Seller’s account will be credited with $21.25
• For each $80 service successfully completed, the Seller’s account will be credited with £72

Custom Orders and Add-ons – percentage commission:

• For all $5 – $24.99 orders successfully completed, we charge commission at 20%
• For all $25 – $79.99 orders successfully completed, we charge commission at 15%
• For $80 – $500 orders successfully completed, we charge commission at 10%
• For all custom orders of $80 or more successfully completed, we charge commission at 10%.

* Starting level 0 pays 20% on each order successfully completed. once you reach a certain sales amount, you will be promoted to level 1 and 2, and above fee structure will apply. Do it really well and Megapig staff will make you a VIP member.

Payment handling

• All orders are handled through megapigs. megapigs will release payment to the Seller on successful completion and delivery of their order
• In order to withdraw revenues, the Seller must have a valid PayPal account or Payoneer account that is set up to receive incoming payments
• Revenues are only made available for withdrawal after a safety clearance period of 3 days
• PayPal imposes a fee for withdrawing revenues, so the more cost effective that is for the seller
• Once funds have been withdrawn from the Seller’s account, they cannot be re-credited
• If for any reason an order is cancelled, the Seller’s revenues will be returned to the Buyer
• Withdrawals are final and cannot be reversed.

Handling orders

• The Seller will be notified by email when a Buyer orders a service.
• The Seller must deliver their completed order within the time frame specified in their service description. Failure to do so will permit the Buyer to cancel the order and may adversely affect the Seller’s ratings.
• The Seller’s ratings are calculated based on feedback received from Buyers, the number of orders completed/cancelled and delivery time frames met.
• Both the Buyer and the Seller have the option to cancel an order by mutual agreement. This will have no negative effect on either party. If the Seller alone decides to cancel an order, this will have an adverse effect on their rating. The seller is not permitted to cancel an order without good cause.

Privacy and guidelines

• Megapigs’s Privacy Policy can be found here.
• Seller and Buyer identities are kept anonymous. In order to protect your privacy, please do not request or provide email addresses, Skype/IM usernames or any other personal contact information.
• The exchange of all communications, information and files should be performed exclusively through the site using the megapigs messaging system.
• Posting or sending illegal, potentially offensive, abusive, copyright protected, promotional, spam, violent or otherwise harmful material will result in your account being disabled.
• We do not accept services that offer to post false reviews. Any listing found to be offering such services will be removed from the site without prior notice to the Seller.
• Please check your local laws and regulations before purchasing any service. Megapigs is not responsible for the use or outcomes of any services hosted on the site, whether intended or otherwise.

Orders – Delivery & communications

• The Seller is responsible for checking that all files they transfer are free of any viruses or malware. Megapigs will not be responsible for any damage incurred as a result of damaged content or files transferred.
• The Seller must deliver completed files and/or proof of work completed using the ‘Deliver Work’ button (located on the Order Page).
• Once an order is delivered, the Buyer has three days to respond to the Seller with any modifications (if these are offered) or to file a complaint. After that time, the order will be marked as completed.
• If a dispute arises between the Buyer and Seller, the parties are encouraged to try and resolve the matter themselves. If this is not possible then the Seller or Buyer may refer the matter to Megapigs Customer Support for arbitration.
• megapigs’s decision is and will be final.

Buyers

Ordering services

• Services may be purchased using a valid debit card, credit card or via PayPal.
• Once payment is confirmed, an order will be created. The Seller will be notified once the Buyer has submitted any required information through the order page.
• If the buyer has specific requirements, they can post a request on the site via the ‘Post a Request’ feature located in the Buyer section of their account.
• If there is credit balance in the Buyer’s megapigs account which is greater than the purchase price of the service required, then payment will be taken from that balance rather than the Buyer’s nominated PayPal account/payment card.
• The Buyer’s identity will remain anonymous at all times. The Buyer is reminded that in order to protect their privacy, they must not request or provide email addresses, Skype/IM usernames or any other personal contact information.
• Payments outside of megapigs for services offered on the site are not permitted. If the Buyer is asked to use an alternative method of payment, they must report it to megapigs’s Customer Support Team immediately
• All complaints should be directed to our Customer Support team. Users are asked to avoid filing a complaint via PayPal or their own bank as this may result in their megapigs account being disabled
• Where an order is eligible for cancellation (e.g. due to late delivery) it can only be cancelled by Customer Support within 7 days of being marked as completed. After this time, the order cannot be cancelled.

Administration fee

All megapigs purchases incur an administration fee of 6%. (already added on the service page)

• Payments refunded to your PayPal account or original payment card following cancellation of an order will include a refund of the administration fee paid.

Shipping

Where the Buyer purchases a service that requires physical delivery, the Buyer will be required to provide a shipping address. The Seller will be responsible for all shipping arrangements once the Buyer supplies the shipping address. megapigs does not handle or guarantee shipping, tracking, quality and condition of items or their delivery and shall not be responsible or liable for any damage or other problems caused, directly or indirectly, as a result of shipping.

General terms

• Any breach of our Terms of Service may result in the offender’s account being permanently disabled.
• Where the Seller’s account has been disabled, they will be able to withdraw their revenues after a safety period of 45 to 90 days from the day of the last cleared payment received in their account. This is subject to our approval, taking into account the nature of the breach/violation.
• We reserve the right to put any account on hold or to permanently disable it due to account misuse. A user whose account is on hold will not be able to sell or buy on megapigs
• From time to time, we may make changes to our Terms of Service.
• megapigs is a EU based company and as such is subject to EU laws
• megapigs pays all required taxes and levies, including VAT on the commission based service it provides. Where applicable, all Buyers and Sellers must ensure that they conform to their local rules and regulations and pay all required taxes associated with the purchase or sale of any service. We will not be held responsible for any liability incurred as a result of the sale or purchase of any services hosted on the site, other than our own legal commitments.

Disputes

• We encourage our Buyers and Sellers to try and settle disputes among themselves. If for any reason they are not able to do so, they can submit a customer support ticket at our support center
• We will not refund payments made for cancelled orders back to the original source of payment in the first instance. Refunds will automatically be credited to the Buyer’s megapigs balance and may be used for future purchases on megapigs. The Buyer may however request that their balance is transferred to their original source of payment by contacting megapigs customer support.

Registration

By registering as a member on megapigs, you agree to megapigs’s Terms of Service and Privacy Policy.

Account use

It is the member’s responsibility to use their account for its intended purpose and in line with megapigs’s Terms. Failure to do so may incur an official warning or account suspension (depending on the violation in question). The following actions may attract an official

warning or account suspension:

• Encouraging service Buyers to pay for services outside of the megapigs website.
• Sharing payment information or personal information that encourages others registered. members to transact outside of the website.
• Sending unsolicited emails to other members about services or products.

Communications from megapigs

Special Offers and Updates

We will occasionally send our members information on products, services, special deals and promotions, if you chose to Opt In. If you do not wish to receive these types of communications you can opt out of receiving them by following the instructions included in the newsletter or communication, or by submitting a customer support ticket here, where you can also ask to ‘Opt-In’.

Copyright and Intellectual Property Policy

This Copyright and Intellectual Property Policy ( “Policy”) is part of and incorporates by reference all terms, conditions rules, policies, and guidelines on the website, including the Terms of Service (the “Terms of Service”). This Policy governs the method and manner that allows you to notify that a third party has infringed on your copyright content or intellectual property rights. By clicking “I accept” or continuing to use the {$sitetitle} Platform, you agree to be bound by this Policy.

1. DMCA Takedown Notice and Copyright Infringement

takes copyright infringement very seriously and intends to abide by US laws relating to the infringement of a user’s copyrights. Pursuant to 17 U.S.C. § 512, referred to hereafter as the Digital Millennium Copyright Act (“DMCA”), has implemented procedures for receiving written notification of claimed copyright infringement in accordance with DMCA rules and regulations.

If you believe another user or a third party has infringed on your copyrights, please send us a takedown notification immediately. Pursuant to the DMCA, your DMCA takedown notification must contain the following:

Identification of the location on our Platform where the infringing copy is posted.

A statement that you swear, under penalty of perjury, that the information contained in this notification is accurate and that you are the copyright owner or have an exclusive right in law to bring infringement proceedings with respect to its use.

2. Counter-Notice Procedures

In the event that you receive a notification from stating content posted by you has been subject to a DMCA takedown, you may respond by filing a counter-notice pursuant to the DMCA. Your counter-notice must contain the following:

Your name, address, email and physical or electronic signature.

The notification reference number (if applicable).

Identification of the material and its location before it was removed.

A statement under penalty of perjury that the material was removed by mistake or misidentification.

Your consent to the jurisdiction of a federal court in the district where you live (if you are in the U.S.), or your consent to the jurisdiction of a federal court in the district where your service provider is located (if you are not in the U.S.).

Your consent to accept service of process from the party who submitted the takedown notice.

Affiliate Terms

1. General

These Terms and Conditions (the "Affiliate Agreement") govern the Affiliate Program that is made available by Megapigs.com Solutions Inc. ("Megapigs.com", "we" or "us"). These Terms and Conditions represent the whole agreement and understanding between Megapigs.com and the individual or entity who participates in the Affiliate Program (the "Affiliate", or "you").

Please read this agreement careful as it represents a legally binding agreement between you and Megapigs.com. By submitting your application and by your use of the Affiliate Program, you agree to comply with all of the terms and conditions set out in this Affiliate Agreement. Megapigs.com may terminate your Affiliate Account at any time, with or without notice, for conduct that is in breach of this Affiliate Agreement, for conduct that Megapigs.com believes is harmful to its business, or for conduct where the use of the Affiliate Program is harmful to any other party.

2. Referral Tracking

Megapigs.com will provide the Affiliate with specific Referral Links to link advertisements and other marketing content to Megapigs.com. Megapigs.com will track users who have visited these Referral Links using cookies which expire after 30 days. Only users who make a purchase while the cookie is active will be considered referrals of the Affiliate and recorded as such in the Affiliate Dashboard.

The Affiliate is not authorized to modify or alter the Referral Links or the cookies in any way. Megapigs.com is not responsible for any tracking or reporting errors that may result from any modifications to the Referral Link or the cookies.

3. Affiliate Fees and Payouts

A referral will become eligible for payout ("Eligible Referral") after an order is successfully completed:

The referral makes a purchase and the job is marked completed and cleared.

The referral's account remains active and in good standing.

The referral's account has not had any of its payments refunded, charged back or otherwise reversed.

All web page error requests (such as 403 errors or 404 errors) will direct traffic to a default Megapigs.com error page. This error page informs visitors that the web page they are looking for cannot be found, and may include, but without limitation to, the following:

Links to additional products and services offered by Megapigs.com.

Advertisements for products and services offered by third-parties.

An internet search engine interface.

Failure to meet any of these criteria will permanently void the referral and disqualify the referral from any potential payouts.

The Affiliate is entitled to receive an one-time maximum payment per referral of $100.00 United States Dollars for each active Eligible Referral that is recorded in the Affiliate Dashboard ("Affiliate Fee"). Affiliate Fees will be payable directly after the purchase is cleared.

All Affiliate Fee payments will be payable in United States Dollars only, except as otherwise determined by Megapigs.com in its sole discretion. Payment will be made through PayPal or Payoneer (if available) against a valid invoice issued by the Affiliate using the invoice generation and submission tool located in the Affiliate Dashboard. The Affiliate is responsible for providing Megapigs.com with the full and accurate details that are required to remit the Affiliate Fees, and is solely responsible for any delays in payment resulting from its failure to do so.

Referrals will become void, and any unpaid Affiliate Fees will be forfeited, after 12 calendar months.

In the event of any activity deemed suspicious by Megapigs.com, Megapigs.com may delay the payment of Affiliate Fees by up to 6 calendar months to verify the relevant transactions. Megapigs.com reserves the right to recalculate, void, or disqualify any referrals or Affiliate Fees in the event of any fraudulent, deceptive or otherwise illegal activity.

Referrals for purchases made through Megapigs.com promotional or special offers are not eligible for payout.

4. Advertisements

Megapigs.com hereby grants the Affiliate a non-exclusive, non-transferable, limited license to use the Megapigs.com logos for the sole purpose of promoting our service within the context of the Affiliate Program. This license will expire upon termination of the Affiliate's participation in the Affiliate Program.

The Affiliate may only display advertisements that contain Megapigs.com's logos or service marks in good taste. The Affiliate may not use Megapigs.com's logos or service marks in a manner that, in Megapigs.com's sole discretion, portrays Megapigs.com in negative light.

The Affiliate will be solely responsible for its own marketing activities. All marketing activities must be professional and in full compliance with all applicable laws.

Megapigs.com may, without prior notice, require the Affiliate to remove or modify any advertisements in Megapigs.com's sole discretion.

5. Termination

The Affiliate may terminate the Affiliate's participation in the Affiliate Program with immediate effect by giving the other party a written notice of termination.

Megapigs.com reserves the right to terminate the Affiliate's participation in the Affiliate Program at any time for conduct that is in material breach of this Affiliate Agreement or for conduct that Megapigs.com, in its sole discretion, deems to be harmful to its business or any third party.

Upon termination, the Affiliate will lose access to its Affiliate Dashboard and will forfeit all potential or unpaid Affiliate Fees.

6. Relationship of Parties

Megapigs.com and the Affiliate are independent contractors. Nothing in this Affiliate Agreement will create any partnership, employment, representative, agency, or joint venture relationship between the parties. The Affiliate has no authority to act on Megapigs.com's behalf.

7. Limitation of Liability

The Affiliate Program is provided on an "as is" and "as available" basis and the use of the Affiliate Program is at the Affiliate's own risk. Megapigs.com makes no representations or warranties, either expressed or implied, with respect to the Affiliate Program, or any service or information provided through the Affiliate Program.

Megapigs.com is not responsible for any damages, injury or economic loss arising from the use of Affiliate Program. Should any part of the Affiliate Program cause damage or inconvenience to the Affiliate or anyone claiming through the Affiliate, the Affiliate assumes responsibility and the entire cost for them.

The Affiliate will indemnify and hold harmless Megapigs.com, its directors, officers, employees, agents, subsidiaries, and third parties from and against any losses, damages, liabilities, claims, judgments, settlements, fines, costs and expenses (including reasonable related expenses, legal fees, costs of investigation) arising out of or relating to the Affiliate's or any third party's operations or use of the Affiliate Program.

8. Modification

Megapigs.com may, in its sole discretion, change or modify this Affiliate Agreement at any time, with or without notice. Such changes or modifications shall be made effective for all Affiliates upon posting of the modified Affiliate Agreement to this web address: https://www.megapigs.com. The Affiliate is responsible for reading this document from time to time to ensure that its use of the Affiliate Program remains in compliance with this Affiliate Agreement.

If any modification is unacceptable to the Affiliate, its sole recourse shall be to terminate this Affiliate Agreement. The Affiliate's continued participation in the Affiliate Program will constitute binding acceptance of such modifications.

9. Miscellaneous

The Affiliate warrants and represents that it is over the age of 13 and is qualified to enter into this Affiliate Agreement.

The Affiliate warrants and represents that its actions and its participation in the Affiliate Program is in compliance with all applicable laws, rules, regulations, and any requirements of governmental authority at all times. Megapigs.com reserves the right to terminate the Affiliate's participation in the Affiliate Program if Megapigs.com determines, in its sole discretion, that the Affiliate's actions or its participation in the Affiliate Program is in violation of any laws, rules, regulations, or any requirements of governmental authority.

This Affiliate Agreement constitutes the entire understanding between Megapigs.com and the Affiliate. This Affiliate Agreement supersedes any other contracts or understandings between the parties hereto and neither party shall be bound by any statements or representations that are not embodied in this Agreement.

Any dispute arising in relation to this Affiliate Agreement shall be exclusively resolved in Court.
